General Terms and Conditions (GTC)*

1. Subject matter of the contract
Dustbag.ch (Multifilt AG) sells the goods to the customer according to the following General Terms and Conditions (GTC). We reserve the right to make written agreements to the contrary in individual cases. These General Terms and Conditions shall be deemed to have been accepted upon conclusion of the contract in accordance with section 2 of our GTC.

2. Conclusion of the contract
The contract between the customer and Dustbag.ch (Multifilt AG) is only concluded by an order from the customer and its acceptance by Dustbag.ch (Multifilt AG). The customer's order is placed via online order. Dustbag.ch (Multifilt AG) accepts the order by immediate advance payment, by an order confirmation (e-mail) or by delivery of the ordered goods. However, Dustbag.ch (Multifilt AG) can withdraw from the contract within 7 days without stating the reason. Amounts paid in advance will be refunded immediately. If the customer (private person) cancels the order after the successful credit check/payment and before dispatch, Dustbag.ch (Multifilt AG) reserves the right to charge a processing fee of CHF 10.

3. Product range 
All information on the goods which the customer receives during the ordering process is non-binding. In particular, changes in design and technology, which improve the functionality of a product, as well as errors in description, illustration and pricing are reserved.

4. Terms of payment/fees
All prices are indicative prices which may be adjusted to the market on an ongoing basis. They are quoted in Swiss francs (CHF), including VAT, excluding small quantity surcharge, postage and packaging. The payment method "Invoice (private customers)" is intended exclusively for private individuals with legal capacity and domicile in Switzerland or Liechtenstein. The billing and delivery address must be identical. The payment method "Invoice (corporate customers)" is aimed exclusively at companies with a valid entry in the commercial register, authorities and institutions based in Switzerland. Transactions are only offered in CHF. As a matter of principle, we reject claims arising from exchange rate differences.

5. Terms of delivery
Delivery is usually made within two to five working days (within Switzerland). Otherwise, a written confirmation with the expected delivery date will be sent. The delivery date is given to the best of our knowledge, but without guarantee. Possible missed deadlines do not entitle the customer to cancel the order or to claim compensation. The delivery of the goods shall be at the expense and risk of the customer, even if partial deliveries are made. If the ordered goods are not collected or accepted, all postage or freight charges incurred (CHF 15.-) shall be borne by the customer. Transport damage must be reported immediately to the carrier. Any shortages must be reported to us by email within 24 hours.

6. Retention of title
In the case of delivery against invoice according to point 4, the delivered goods remain the property of Dustbag.ch (Multifilt AG) until actual payment has been made.

7. Right of return
The return of articles by the customer requires the prior consent of Dustbag.ch (Multifilt AG) and is at the expense and risk of the customer. The return of the articles has to be made with mention of a return number. Without notification and consent, Dustbag.ch (Multifilt AG) can refuse to accept the return. 8. Warranty for defects and liability
For all products offered by Dustbag.ch (Multifilt AG) the warranty period applies according to the regulations of the product manufacturers starting from the date of purchase. The guarantee expires if changes or repairs are made to the goods without the written consent of Dustbag.ch (Multifilt AG). As far as the legal regulations allow, the liability for damages is excluded. In particular, Dustbag.ch (Multifilt AG) is not liable for damages that can be traced back to improper use or natural wear and tear or for damages that have not occurred to the delivery item itself (consequential damages).

9. Intellectual property
Dustbag.ch (Multifilt AG) reserves all rights for every design, every text, every graphic on its website. Copying or any other reproduction of the entire website or parts of the website is only permitted for the purpose of placing an order with Dustbag.ch (Multifilt AG). All page headers, navigation bars, graphics and button icons are the intellectual property of Dustbag.ch (Multifilt AG). All other trademarks, product names or company names or logos cited on this website are the sole property of their respective owners. Dustbag.ch (Multifilt AG) reserves the property rights and copyrights to illustrations, drawings, calculations and other documents. The customer requires the express written consent of Dustbag.ch (Multifilt AG) before passing them on to third parties.

10. Data protection
Dustbag.ch (Multifilt AG) assures to observe the provisions of the Swiss Data Protection Act and the relevant legal standards when collecting, processing and using personal data. Data will only be passed on to third party partner companies if this is absolutely necessary for the proper provision of services (order processing). The customer agrees to this use of their data.

11. Jurisdiction and applicable law
These GTC and the contracts concluded on the basis of these GTC are subject to Swiss law. The place of jurisdiction for the customer and for Dustbag.ch (Multifilt AG) is the registered office of Dustbag.ch (Multifilt AG). However, Dustbag.ch (Multifilt AG) is also entitled to take legal action against the customer at his registered office or place of residence.

12. Final clauses
For the sale of goods specified by Dustbag.ch (Multifilt AG), the GTC in the version valid at the time of the respective conclusion of the contract shall apply exclusively. These terms and conditions shall apply in particular even if they should differ from those of the clientele. Should individual provisions of these GTC be or become invalid, this shall not affect the legal validity of the remaining provisions. Furthermore, Dustbag.ch (Multifilt AG) reserves the right to change these general terms and conditions at any time.
